Terms of Use for ProtonChess

These Terms of Use (“Terms”) govern your use of the ProtonChess mobile application (“App”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 13 years old to use the App.
• If you are between 13 and 18, you must have parental or legal guardian permission.
• The App is not directed at children under 13, and we do not knowingly collect personal information from them.

2. Your Account

• If you register, you may choose a username. You are not required to provide your real name or email address for normal use.
• You are responsible for all activity under your account.

3. Prohibited Conduct

You agree not to:

• Post, upload, or share any harassing, threatening, bullying, defamatory, obscene, or hateful content.
• Exploit minors or engage in any harmful activity.
• Impersonate any person or entity.
• Violate any law (including Lichess’s terms of service).
• Introduce viruses or malicious code.

We may suspend or terminate access for violations.

4. Lichess API Compliance

• The App uses the official Lichess API to fetch puzzles and game data.
• Your use of Lichess services through this App is also subject to Lichess’s Terms of Service.
• You agree not to use the App for automated playing (“bots”) on Lichess unless you have a dedicated bot account.

5. Subscriptions & Payments (if applicable)

• Billing – Payments are processed by the App Store. We do not collect financial information.
• Recurring charges – Subscriptions automatically renew unless cancelled at least 24 hours before renewal.
• Cancellation – Cancel anytime via your App Store account settings. Deleting the app does not cancel your subscription.
• Refunds – Handled by the App Store according to its refund policy.

6. Intellectual Property

• All app content that is not user‑generated (UI, icons, branding) is owned by ProtonChess or its licensors.
• You may not copy, modify, or reverse‑engineer any part of the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE MAKE NO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR‑FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTONCHESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold ProtonChess harmless from any claims arising from your violation of these Terms.

10. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the Philippines.
• Disputes shall first be attempted to be resolved through good‑faith negotiation.
• If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (or local equivalent), held in Manila, Philippines.

11. Changes to These Terms

We may update these Terms. Continued use after changes means you accept the new Terms.
